These Terms of Service ("Terms") govern your access to and use of the MomenZone iOS application ("the App") provided by MomenZone ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. About MomenZone
MomenZone is a personal diary and memory journal app. The App lets you create, edit, organize, and view private diary entries with photos, tags, drafts, favorite layouts, and timeline/history browsing. You can choose cover layouts (Minimal, Magazine, or Poster), export entries as PDF files, and manage a local profile with nickname and avatar. Virtual coin features are described below.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority where you live, you may use the App only with permission from a parent or legal guardian who accepts these Terms on your behalf.
3. Access and Session
You do not need to provide a username or password or complete manual registration to begin using the App. When you tap Start, the App automatically establishes a pseudonymous app session and you agree to the Privacy Policy and these Terms shown on the entry screen. You are responsible for activity that occurs through the App on your device.
- Return to Start: ends the current app session and returns to the entry screen while keeping diary content and profile data on the device.
- Delete Data: permanently removes your diary entries, profile data, coin balance and history, avatar files, and associated local files from your device. Some purchase transaction identifiers and the one-time welcome-grant flag may be retained locally to prevent duplicate coin crediting.
4. Your Content
You retain ownership of the diary text, photos, tags, and other content you create or upload ("User Content"). By using the App, you grant us a limited, non-exclusive license to process User Content solely as needed to operate App features — for example, storing content locally on your device, rendering cover layouts, and exporting PDFs.
You represent that:
- You have the rights needed to upload and use your User Content in the App.
- Your User Content does not violate applicable law or infringe the rights of others.
- You will not upload unlawful, harassing, hateful, sexually exploitative, or otherwise harmful material.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Attempt to reverse engineer, decompile, or interfere with the App or its security features.
- Use automated means to scrape, overload, or disrupt the App or related services.
- Misrepresent your identity or impersonate another person.
- Circumvent coin balances, in-app purchase flows, or feature restrictions.
We may suspend or terminate access to the App if we reasonably believe you have violated these Terms, though most enforcement actions are limited to device-local access controls because the App does not operate a public social network.
6. Virtual Coins
Important: Coins are a virtual in-app currency with no real-world cash value outside the App. Coins are non-transferable, non-refundable except as required by law, and cannot be exchanged for money or prizes.
Current coin rules in the App include:
- Welcome grant: first-time use may receive a one-time grant of 255 coins. This grant is tracked on your device and is not restored after data deletion.
- New diary entry: publishing a new diary entry through the cover layout flow costs 85 coins. Editing an existing entry does not incur this charge again.
- Premium cover templates: Magazine and Poster layouts cost 15 coins each to unlock permanently on your device. The Minimal template is free.
Coin costs, welcome grants, and feature pricing may change. Material changes will be reflected in the App or in updated Terms where appropriate.
7. In-App Purchases
You may purchase coin packs through Apple's App Store using in-app purchase (StoreKit). All purchases are processed by Apple and are subject to Apple's terms and payment policies. Prices are displayed in the App at the time of purchase and may vary by region.
Coin packs are consumable digital goods credited to your local coin balance after a successful purchase. We are not responsible for billing issues handled by Apple. For refund requests, contact Apple support in accordance with Apple's refund policies. Because balances are stored locally on your device, we do not guarantee that coins will sync or restore across different devices unless otherwise stated in the App.
8. Device Permissions and Exports
The App may request access to your camera and photo library to attach images to diary entries, update your avatar, and save exported files when you choose to export or share content. You can manage permissions in iOS Settings. If you deny permission, related features may not function.
When you export or share content using iOS system features, that sharing is under your control and may be governed by the policies of the destination app or service.
9. Intellectual Property
The App, including its design, branding, software, and original content (excluding User Content), is owned by MomenZone or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App except as expressly permitted by these Terms or applicable law.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF LOSS OF DATA.
Because most content is stored locally on your device, you are responsible for backing up your device and protecting access to it. Uninstalling the App or losing your device may result in loss of diary content unless you have separately saved or exported it.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENZONE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US THROUGH IN-APP PURCHASES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless MomenZone and its affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the App, or your violation of these Terms or applicable law.
13. Changes to the App and Terms
We may update the App and these Terms from time to time. When we update these Terms, we will revise the "Effective" date at the top. Continued use of the App after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the App and may delete your data.
14. Termination
You may stop using the App at any time by returning to the entry screen, deleting your data, or uninstalling the App. We may discontinue or modify the App or any feature at any time, with or without notice, to the extent permitted by law.
15. Governing Law
These Terms are governed by the laws applicable in your place of residence, except where mandatory consumer protection laws of your jurisdiction require otherwise. Any disputes will be resolved in the courts of competent jurisdiction in your place of residence, unless applicable law requires a different forum.
